1. Agreement to Terms

By accessing or using RndrKit ("the Service"), operated by BSquared Technologies LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The Service is available at https://rndrkit.io.

2. Service Description

RndrKit is a pre-rendering-as-a-service platform. We render your Single Page Application (SPA) content into static HTML and serve it to search engine crawlers, improving your site's SEO crawlability. Human visitors are proxied directly to your origin site without modification.

We do not guarantee specific search engine rankings, indexing speed, or SEO outcomes. Pre-rendering solves the technical crawlability barrier; search performance depends on many factors outside our control.

3. Account Terms

You must provide accurate information when creating an account (via Google or GitHub OAuth).
You are responsible for maintaining the security of your account and any activity that occurs under it.
You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service.
One person or legal entity may maintain no more than one free or trial account.
You must notify us immediately of any unauthorized use of your account.

4. Payment and Billing

Paid plans are billed monthly through our payment processor, LemonSqueezy. Current plan details, features, and pricing are available on our pricing page.

All plans include a 14-day money-back guarantee. If you are unsatisfied within the first 14 days of your subscription, contact us for a full refund.
Subscriptions renew automatically each billing cycle unless cancelled.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
If you exceed your plan's render limit, we will notify you at 80% usage and provide a 20% grace period. No overage charges apply; cached content is served until your next billing cycle.
Prices may change with 30 days' notice. Existing subscribers will be notified by email before any price increase takes effect.

5. Acceptable Use

You agree not to use the Service to:

Render, cache, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
Attempt to gain unauthorized access to the Service, other accounts, or our systems.
Use the Service to engage in search engine manipulation, cloaking, or deceptive SEO practices that violate search engine guidelines.
Transmit malware, viruses, or any other harmful code through the Service.
Resell or redistribute the Service without a valid Agency plan or written authorization.
Overload or interfere with the Service's infrastructure through excessive automated requests outside normal crawling patterns.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

6. Intellectual Property

You retain all rights to the content on your origin website. By using the Service, you grant us a limited, non-exclusive license to fetch, render, cache, and serve your content solely for the purpose of providing the pre-rendering service.

The RndrKit name, logo, and all related branding are the property of BSquared Technologies LLC. You may not use our trademarks without prior written consent, except as permitted under an Agency plan with white-label branding.

7. Indemnification

You agree to indemnify, defend, and hold harmless BSquared Technologies LLC and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service or any activity under your account.
Content on your origin website that is rendered, cached, or served through the Service, including any claims of intellectual property infringement, defamation, or illegality.
Your violation of these Terms or any applicable law.
Any third-party claims arising from the content you route through the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BSQUARED TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Service Availability

We strive to maintain high uptime for the Service but do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to scheduled maintenance, upgrades, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime when possible.

10. Force Majeure

BSquared Technologies LLC shall not be liable for any delay or failure to perform its obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, labor disputes, government actions, power failures, internet or telecommunications failures, third-party service provider outages (including but not limited to AWS, Cloudflare, and LemonSqueezy), cyberattacks, or pandemics.

11. Termination

You may terminate your account at any time by cancelling your subscription and contacting us to delete your account.
We may terminate or suspend your account immediately, without prior notice, if you violate these Terms.
Upon termination, your right to use the Service ceases immediately. Your DNS records will need to be updated to point away from RndrKit.
We may retain cached versions of your content for a reasonable period after termination for technical purposes, after which they will be permanently deleted.

12. Dispute Resolution

12.1 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall take place in Washington County, Utah, or remotely at the mutual agreement of the parties. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.2 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

12.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against BSquared Technologies LLC. If this waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of laws provisions. Subject to the arbitration provisions above, any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Washington County, Utah, and you consent to the personal jurisdiction of such courts.
